UK default retirement age of 65 justified

An Advocate-General, a senior legal adviser to the European Court of Justice, has supported the UK decision that workers can be compelled to retire at 65 years of age. Age concern is challenging the UK position that workers can be compelled to retire at age 65 despite the implementation of the Age Discrimination Regulations 2006. The Advocate-General stated “a rule which permits employers to dismiss employees aged 65 or over if the reason for dismissal is retirement, can in principle be justified”. The Advocate-General’s view is not binding but could influence the judges in the European Court of Justice who are expected to give their ruling in this case before Christmas.
