TheJudge recruits ATE insurance insolvency expert
TheJudgeLimited, the 's largest independent broker specialising in ATEinsurance (After the event insurance) and Third Party Funding, has recruitedEmma Knights, an insolvency expert. Joining TheJudge from First Assist, Emmabrings a wealth of experience and expertise and will make TheJudge the firstport of call for many lawyers and insolvency practitioners dealing ininsolvency litigation.Emma commented;"With the variety of funding options now available and the primary focusof this business being on meeting the client's needs I felt the role on offercomplemented my own approach to relationship management so I joined TheJudge asTechnical Business Development Director on 1st October 2008. I will be based inthe Worthing office and using my experience to focus primarily ondeveloping the Insolvency account and ensuring all TheJudge's insolvencyclients have access to a suite of options to meet their needs. I will also beworking closely with the Broking and Operations Team to grow the businessacross all areas of litigation. The lastfew years have seen a significant increase in the number of Insurers and thirdparty funders willing to provide solutions in Insolvency litigation. TheJudgeaccesses all the leading funding and insurance markets and are atthe cutting edge of product innovation. Asset recovery actions have been theprimary focus of most providers over the last few years but issues withinvestigation costs, interim funding and enforcement create their own problemsand can result in cases not being pursued. TheJudge have solutions to addressthese issues without cost to the Insolvency Practitioner and because they actfor the IP they don't carry the inherent conflict of any one insurer or funder. We will be looking at all types of litigation undertaken by the InsolvencyPractitioner in any capacity whether as an Adminstrator, Liquidator, Trusteeetc. The issue with Insolvency litigation is that there areoften limited funds, if any, to explore pursuing litigation. Solicitors andCounsel may/may not be willing to act on a CFA basis and the InsolvencyPractitioner may prefer that they do not as this will entitle them to a successfee and could result in higher costs, but most Insurers insist on a CFA.Injunctions to freeze assets may be required but interim cover is not provided.Enforcement of any judgement may be problematic and this needs to be taken intoaccount. With the economic downturn the number of companies in financialdistress is going to increase. They may have prospective/ongoing litigationwhich could change their financial circumstances but they may have toreconsider continuing an action if finances restrict them. It is thereforeessential that they are made aware of the availability, flexibility and varietyof funding solutions which are available."
